I am the owner of a Power Sport shop in San Antonio, Tx.

I am Franchised to carry products from:

Coolster, Vitacci and RPS

These products include:

Scooters, Motorcycles, ATVs, Dirt Bikes and Go Karts

My # is P125099 – Franchise License: C169510

The reason for this email is because on March 26, 2026, I filed complaints:

26-0012783 – C&H Power Sports

26-0012773 – Shan Electronics

The results of the complaints is a citation was given to one of them and no action was taken on the other one.

The investigator said that the complaint is only valid for Scooters and Motorcycles because they are road worthy and are Titled and Registered.

I called TxDMV Enforcement Division and when I questioned the person, I was told they did not know if the law applied to ATVs, Dirt Bikes and Go Karts.

That person in turn referred me to your email address.

I believe that the law to not sell the same products from the same Distributor and Manufactorer applies to all items listed on my Franchise License.

Otherwise why would I need to be approved as a Dealer for these products in the first place.

Also, when I pay the fee everytime I renew, the fee is dependent on the number of units sold for the previous year including ATVs, Dirt Bikes and Go Karts.

I also need to provide the Evidence of Franchise which has to include the ATVs, Dirt Bikes, Go Karts, etc before I am legally allowed to buy and sell at my shop.

So, could you please let me know if I am correct on this issue?

Also, if I am correct, the Inspector needs to be notified and issue the appropriate citation to the 2 business who I believe are in violation of the Franchise License Law.
